This Residential limited warranty only covers Orion Quartz Surfaces that have been purchased from an Authorized dealer and permanently installed by an authorized installer. A proof of purchase will be required to authenticate the purchase.

Under this Limited Warranty, Primus Surfaces or its authorized agents must be permitted sufficient time and opportunity to inspect the product, evaluate and respond to any claim. This is a product warranty only and does not cover any additional labor to remove, fabricate and/or reinstall the product or any other tasks necessary to complete the replacement or removal of the defective material. These labor costs are the responsibility of the customer.

All decisions regarding the existence of any manufacturing defects or affecting this warranty shall be made by Primus Surfaces, the decision will be final and binding upon all parties.

The professional fabricator/installer is responsible to inspect the Orion Quartz material before fabricating and/or installing, it is also the homeowner’s responsibility to inspect the installed product. This warranty does not cover any defects that were visible at the time of fabrication/installation and were not avoided during fabrication/installation. All parties must agree to comply with the terms and conditions outlined in this Residential Lifetime Limited Warranty.

Exclusions:

• Any installation at a residence where the owner is not the occupant.
• Any product installed and/or located outdoors.
• Any additional modifications such as plumbing, electrical, tile, cabinets, flooring that may be necessary to repair or replace Product covered under this warranty.
• Any changes to Product thickness or re-polishing of the surface.
• Any Chips or cracks as a result of dry cutting or as a result of impact.
• Any Commercial uses including but not limited to use in a store, rental property, office or any other place of business.
• Any Damage caused by an act of nature.
• Any Damage because of improper installation and/or non-use of heat tape around cook-top, installation of heat shield above, behind and surrounding cook-top.
• Product Sample not matching the exact color of the product.
• Any damage caused by sub-structure support.
• Poor installation or maintenance or dissatisfaction with how the seams and joints appear including the mitered edges.
• Creative use of the product, such as curving or bending.
• Installations in such as boats, recreational vehicles, flooring, etc.
• Any damage caused by misuse or abuse of Product, including uneven exposure to direct sunlight, discoloring caused by exposure to certain chemical agents and damage from exposure to excessive heat.
• Any abnormal use, any abnormal conditions or abuse in any way, which includes, but is not limited to, damage from mishandling or misuse, damage from excessive heat, scorching or exposure to weather conditions, exposure to ultraviolet light, discoloring caused by exposure to certain chemical agents, acid etching, staining or damage from improper care and maintenance. • Quartz is a natural product, any natural variations in color, size, shape and pattern distribution of the natural quartz or background tone.
• Installed product moved from its original place of installation. Scratch and abrasion marks caused by cleaning agents (please refer the care & maintenance of Orion Quartz Surfaces)
• Securing mechanical fasteners directly to the Product and fasteners for sink installation.
• Final installed product that the Owner’s do not like after installation due to color, edging profile or any other opinions based upon personal taste & preference regardless of whether viewed as a defect by the customer.

Primus Surfaces is not responsible for damage or injury caused in whole or in part by acts of God, jobsite conditions, architectural/engineering design and structure movement, acts of vandalism or accidents.

Except as provided in this warranty, Primus Surfaces shall not be liable in either tort or contract for any loss of direct, consequential or incidental damages arising out of the use or in the ability to use this Product in residential applications covered under this warranty. Some areas do not allow the exclusion or limitation of incidental damages, so the above limitation may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights that vary from State to State.

Primus Surfaces makes no other guarantee, representation, or warranty (express or implied) with respect to its products, except as expressly stated herein. No one other than Primus Surfaces is authorized or permitted to make or provide any promise, representation or warranty with respect to Orion Quartz Surfaces.

Primus Surfaces will seek to obtain the best possible result, whether it is to repair or replace the product, however, exact color match is never guaranteed.
